Official Rules for FOX Rochester's
"Race to Win" NASCAR Contest
NO PURCHASE NECESSARY.
Void where restricted by law.
1. Eligibility: Open to legal residents of Rochester, NY, television DMA (Designated Market Area) who are 18 years of age or older, Employees of Nexstar Broadcasting Company dba News 8 (WROC) or Fox Rochester (WUHF), Sinclair Broadcasting, Mark's Pizzeria, Dick Ide Honda, or employees of their respective affiliates, advertising, or promotion, security, cleaning, and other leased employee agencies and their immediate families or persons residing in the same household of each are not eligible. If any entry rule is violated, all entries from that person or IP address become null and void. Entrants may not have won a prize from WROC/ WUHF/ rochesterhomepage.net in the previous ninety (90) days prior to start of contest / drawing, in this case, November 12, 2011..
2. How to Enter: Contest begins at 8:00 p.m. EST, February 10, 2012, and ends 12:15p.m. Eastern Time Sunday, June 3, 2012, which is the day of the final scheduled televised race on FOX for the 2012 season. NOTE: Players may keep playing for NATIONAL prizes beyond this timeframe, and into November, but the ROCHESTER portion of the contest concludes with the results of the June 3 race. To enter, register online at RochesterHomePage.net "Race To Win" Contest via the Upickem/Second Street Media contest module. Prior registration for any Upickem/Second Street Media contest may apply to new users of the "Race to Win" contest application. Odds of winning depend on number of eligible entries received, and accuracy of entrant's predictions/picks. Note that winners may be videotaped for broadcast.
3. How to Play: All eligible contestants will abide by contest participation guidelines as set forth by Upickem/Second Street Media as follows: For each race, pick the drivers you think will finish in 1st through 10th place for the race. Picks must be submitted at least 15 minutes before the race is scheduled to start. Entrants will be awarded points depending on how the drivers they select finish the race. 1st place is worth 150 points, 2nd place is worth 125 points, 3rd place is worth 100 points, 4th place is worth 80 points, 5th place is worth 78 points, with the number of points being reduced by 2 points for each subsequent place from 6th place (76 points ) to 43rd place (2 points). Drivers who finish in 44th place and beyond will not receive any points. The total points for the ten drivers you selected for the race becomes the Team Score. There is a 25 point bonus for each driver that comes in the exact place you picked the driver to finish, e.g., if you picked a driver to finish in 2nd place and the driver finishes in 2nd place, you will receive a 25 point bonus to the Team Score.
Your total score for the Contest will be the combined sum of your best 15 races.
If there is a tie for the most points for a race, the tie breaker will be based first on which tied entrant had the most drivers picked in the correct place for the race. If there is still a tie, the entrant who picked the highest place correct will be declared the winner. If there is still a tie, the computer will randomly select a winner from the remaining entrants that are still tied after the first two tie-breakers.
If there are ties for overall score, the entrant with the most points for the most recent race will be declared the winner. If there is a tie, the computer will continue comparing race points for the most recent previous races, one-by-one, until a winner is selected. If any entrants are tied for all the races, the computer will randomly select a winner from the entrants that are tied for all races.
Points are awarded for the drivers, not cars. If an entrant picks a driver who qualified for race and a new driver took his/her place before the start of the race, the entrant must pick the new driver. Entrants will not receive points even though the new driver may be racing the car of the driver that the entrant selected. And, if the new driver is not in the list of drivers that can be picked then no entrants shall have the ability to pick that driver.
Weekly winners are not posted until the official governing body for the race has released the official race results and any modifications to the finish order have been made. This can be anywhere from 24 to 48 hours after the conclusion of the race. Any modifications to the race results after the official race results are posted will not be considered.
Limit one (1) entry per person, per race. Prize winners will be required to sign an affidavit of eligibility, advertising and liability release within 1 day of notification or prize will be forfeited. Winners must be able to provide either a Social Security Card or birth certificate, and an official photo ID (New York State License, Official State ID, or Military ID) to verify age and residency. Verification could take up to one hour as identification is verified, waiver/agreement forms are signed and winners may be videotaped for broadcast. If travel to News 8/WROC-TV is determined by the judges to be an extreme difficulty, arrangements will be made to conduct the verification process by mail. If the winner does not provide adequate verification, then they forfeit winning and another random drawing will be held to determine a winner. Judges' decisions are final
4. Prizes:

Grand Prize
After the conclusion of the June 3, 2012 race at Dover, one (1) winner from the Rochester DMA pool of contestants will receive:
- $150 gift card from Mark's Pizzeria
-One (1) Dirt 3 game for the XBOX 360 (value = $40)
Weekly
Up through and including the June 3, 2012 Dover race, one weekly winner from the Rochester DMA pool of contestants will win the following:
-$25 gift card from Mark's Pizzeria
NATIONAL (concludes after season is over, expected to be after the November 18, 2012 race at Homestead)
Grand Prize
One NATIONAL winner receives a $1,500 gift card to amazon.com
Weekly
The weekly contestant with the highest score in the national pool of contestants will win the following:
- NASCAR Fathead wall decal (value: $100.00)
All prizes will be awarded based on selection of winner as described in above section 'How To Play.' All decisions made by judges/Upickem/Second Street Media are final.
Winner will be responsible for all federal, state or other applicable taxes in connection with the receipt of prizes. The winner may be required to complete a federal IRS W-9 form and have identity verification information ready to present at time of prize pickup. If the selected winner does not meet official rules and regulations qualifications, the prize will be forfeited and an alternate winner will be selected. Upon forfeiture, no compensation will be given.
5. Notification: Winners will be notified by e-mail. All posted results are unofficial until winners are verified. If a winner does not respond within three (3) days of the initial notification email, the prize will be forfeited and awarded to the next highest scoring participant. Sponsor is not responsible for any change of email address, mailing address and/or telephone number of participants. By participating in this promotion and submitting an entry, entrants agree to be bound by these Official Rules and the decision of the judges. By entering the drawing, winners agree to waive any and all claims against the Sponsor, its affiliates, employees, agents, directors, and representatives for any and all claims, including but not limited to personal injury or loss that may occur from the voluntary participation in this drawing or from the receipt or use of any prize, and grant to Sponsors the right to publicize such winner's name and/or likeness without additional compensation or consideration unless prohibited by law.
6. General Conditions: Sponsors, their affiliates, employees, agents, directors and representatives are not responsible for printing or typographical errors in any contest-related materials; stolen, late, lost, delayed, misdirected, damaged, incomplete, postage due or illegible entries. Sponsor, its affiliates, employees, agents and representatives, or any telephone network or internet service providers are not responsible for incorrect, inaccurate transcription or loss of entry information for any reason whatsoever. If, in the Sponsor's exclusive judgment, this promotion becomes compromised in any way, Sponsor reserves the right to withdraw the promotion offer, cancel any method of entry, to void any entries submitted fraudulently or select winners from all eligible entries received prior to act that compromised the promotion. By entering, entrants acknowledge compliance with these official rules including all eligibility requirements. Any attempt to deliberately damage the content or operation of this sweepstakes is unlawful and subject to legal action by the Sponsor or its agents. In the event of dispute, electronic entries will be deemed to have been submitted by the authorized account holder of the e-mail address at the time of the sweepstakes. The authorized account holder is the person to whom the applicable Internet service provider or other organization (such as business or educational institution) has assigned the e-mail address. The judges reserve the right to verify eligibility qualifications of winners and to disqualify any individual they find to be acting in violation of the Official Rules. Decisions of drawing sponsor judges, FOX Rochester/WUHF are final.

8. PRIVACY NOTICE: Information you provide in connection with this contest is subject to Sponsor's Privacy Policy and will be shared with your local affiliate.
9. LIMITATIONS OF LIABILITY: Sponsor and Promotion Parties are not responsible for Internet crashes or slowdowns caused by network congestion, viruses, sabotage, satellite failures, phone line failures, electrical outages, natural disasters or acts of man or God, lost, late, misdirected, postage-due, unintelligible, returned, undelivered entries or email, or for lost, interrupted or unavailable satellite, network, server, Internet Service Provider (ISP), Website, or other connections availability, accessibility or traffic congestion, miscommunications, failed computer, network, telephone, satellite or cable hardware or software or lines, or technical failure, or jumbled, scrambled, delayed or misdirected transmissions, computer hardware or software malfunctions, failures or difficulties, or other errors of any kind whether human, mechanical, electronic or network. Persons who tamper with or abuse any aspect of this Contest or Website, or act in violation of the Official Rules, or act in any manner to threaten or abuse or harass any person, or violate Website's terms of service, as solely determined by the Sponsor, will be disqualified. Neither Sponsor nor Promotion Parties are responsible for any incorrect or inaccurate information whether caused by Website users, tampering, hacking, or by any of the programming or equipment associated with or used in this Contest, and assumes no responsibility for any errors, omission, deletion, interruption or delay in operation or transmission or communication line failure, theft or destruction or unauthorized Website access. Any use of robotic, macro, automatic, programmed or like methods of play will void all such plays, and may subject that participant to disqualification. Sponsor reserves the right at its sole discretion, to disqualify any individual (and all of his or her submissions) who tampers with the submission process. Neither Sponsor nor Promotion Parties are responsible for injury or damage to participant's or any other person's computer or property related to or resulting from participating in this Contest. Should any portion of Contest be, in the Sponsor's sole opinion, compromised by virus, worms, bugs, unauthorized human intervention or other causes which, in the sole opinion of the Sponsor, corrupt or impair administration, security, fairness or proper play of this Contest, or Contest plays, Sponsor reserves the right at its sole discretion to suspend, modify or terminate the Contest.
